LA REGOLA: COSA PREVEDE LA LEGGE?

A seguito della legge costituzionale n.1 del 1999 (che introdusse, per le regioni ordinarie, l’elezione diretta dei presidenti di regione), la legge quadro dello Stato n. 165 del 2004 ha fissato alcuni “principi generali” cui le regioni sarebbero state vincolate nel rinnovare la propria legislazione elettorale.
Tra questi, vi è il principio della “non immediata rieleggibilità”, allo scadere del secondo mandato, del presidente della giunta regionale eletto a suffragio universale e diretto (in pratica, un “divieto di terzo mandato” consecutivo per i governatori).

Due sono i punti più “controversi” di tale normativa:
I- tale principio è “direttamente applicabile” (a prescindere dall’emanazione di una conforme legge regionale)?
II- inoltre, lo stesso deve intendersi “retroattivo” (nel novero dei mandati consecutivi, dunque, devono ricomprendersi anche quelli precedenti l’entrata in vigore della legge n. 165 del 2004)?
Pur essendo vero che il legislatore statale non si è espresso in maniera inequivoca, la risposta comunemente data dal mondo giuridico-accademico è, però, positiva ad entrambi i quesiti.

E’ vero, infatti, che la legge del 2004 rinvia, per la “disciplina di dettaglio”, alla legislazione regionale (che, colpevolmente, in alcune regioni, tra cui Lombardia ed Emilia Romagna, non è ancora stata emanata), ma i maggiori costituzionalisti si sono espressi in favore della “diretta applicabilità” del principio su esposto.
Se così non fosse, del resto, si otterrebbe il risultato paradossale:
- di vincolare le regioni “solerti” (nell’approvare una nuova legislazione regionale) a dare immediata applicazione alla legge dello Stato;
- e di premiare, di contro, le regioni “inadempienti” (lasciandole libere di violare apertamente un “principio fondamentale” sancito da una legge dello Stato)!

Gli esperti, inoltre, concordano nel sostenere la “retroattività” del divieto.
Per far scattare il “vincolo del doppio mandato”, quindi, occorre tenere conto:
- non solo dei mandati vigenti (o successivi) al momento dell’entrata in vigore della legge n. 165 del 2004;
- bensì anche di tutti quelli “immediatamente precedenti” all’entrata in vigore della legge.

No soy de los que pasa su tiempo mirando páginas webs de como van los debates en relación con el movimiento libertario y el anarquismo. Lo señalo no porque considere que sea mejor o peor o una pérdida de tiempo, pero si me preocupa que lo virtual convierta en realidad lo que no existe. Simplemente lo señalo. Tampoco normalmente me meto en polémicas, no es mi estilo, insisto, ni mejor ni peor, de quien dedica un tiempo importante de su vida a estos menesteres. Por tanto, en este caso y algún otro, excepcionalmente, de cuando en cuando planteo lo que pienso. En lo que va a continuación, puede haber errores al no tener notas de los debates que se han dado sobre el tema, solo está la memoria. Teniendo en cuenta que ya tengo unos años, posiblemente la misma falle más de lo normal. Si dispongo del último artículo, publicado en el Boletín nº 14 de Cuba Libertaria, de mi amigo Octavio, quien cuando lo necesité lo tuve ahí (son apoyos que no se olvidan). read full story / add a comment

Il me semble qu’une partie des attaques du camarade Octavio Alberola contre Chomsky (article en castillan paru en septembre 2009 et repris en décembre sur ainfos) ont peu de fondement, car il ne s’est pas souvenu de positions élémentaires de Noam. Et je suis d’accord avec Octavio pour signaler des contradictions de Chomsky, encore que ce ne soient pas les mêmes.

Un autre plan complexe, est celui de la critique de Cuba et du Venezuela de Chávez, en écartant les arguments fallacieux qui cherchent à passer sous silence la rébellion, et en jugeant une réalité avec des aspects ouvriéristes, sans blesser les travailleurs, surtout latino-américains, qui maintiennent une certaine confiance dans des directions et des leaders qui ne nous paraissent ni fiables ni sérieux.

Me parece que parte de los ataques del compañero Octavio Alberola a Chomsky tienen poco fundamento, porque no recordó posturas elementales de Noam. Y coincido con Octavio en señalar contradicciones de Chomsky, aunque no sean las mismas.

Otro plano complejo, es la crítica de Cuba y de la Venezuela de Chávez, descartando los argumentos falaces que buscan acallar la rebeldía, y juzgando una realidad con visos de obrerismo, sin herir a los trabajadores, sobre todo latinoamericanos, que mantienen cierta confianza en direcciones y líderes que no nos parecen ni fiables ni serios.

La victoria electoral de Evo Morales y el movimiento al socialismo, con un 63% de votacion, solo muestra la total derrota del levantamiento revolucionario popular que se dio en el 2003... En otras palabras solo muestra la derrota del movimiento popular boliviano.

This week the focus was on the straggle against transfer in Seikh Jarrah, and a one year "aniversory" to the Israeli war crime onslout on the Gaza strip - the world largest concentration camp. In Sheikh Jarrah activists tried to help during the week - in addition to the Friday demonstration. For gaza, we both participated in the joint demonstration on Saturday evening in Jaffa and in Sunday walking on the Zikim beach towards Gaza. The usual Friday demonstrations in Bil'in and Ma'asera were adhered to. The Ni'ilin Friday demonstration was preceded with a second demo in Shukba. read full story / add a comment
